Do Voluntary Internships Count Against Your Work Days?

The rule turns on one question: did your programme make you do it? A mandatory internship written into your curriculum is treated as study, so it costs you nothing from your work allowance. A voluntary internship you found and arranged yourself is treated as work, and every day of it comes off the same 140/280 total as a shift in a warehouse.

What the law actually counts

Section 16b of the Residence Act gives you an Arbeitstagekonto, a working-day account, capped at 140 working days a year. Two things about how it is filled matter more than the headline number.

First, student side jobs at your own university are not charged to the account at all. Second, part-time employment is counted in whichever way is most favourable to you, and that comparison is made week by week. There are two methods:

• By day. A day on which you work up to four hours counts as half a working day. Any longer day counts as a full one. Note what that means: there is no eight-hour cap on a "full day". A five-hour shift and a ten-hour shift both cost exactly one day.
• By week. A calendar week counts as two and a half working days. During the lecture period this applies only if you work up to 20 hours in that week. Outside the lecture period it applies regardless of how the hours are spread.

The second method is the one that makes an internship in the semester break cheap and the same internship during term expensive.

What a three-month voluntary internship really costs

Take a full-time placement, five days a week, thirteen weeks. Run the two scenarios.

1. Entirely in the lecture-free period. The weekly method applies with no hours condition, so the internship costs 13 weeks at two and a half days, which is 32.5 of your 140 days. You still have well over a hundred left for the rest of the year.
2. During the lecture period. Full-time is more than 20 hours a week, so the weekly method is unavailable and the daily method applies: five full days a week for thirteen weeks, 65 days. Nearly half the annual allowance, for the same placement.

Why the distinction is expensive

A voluntary placement in the wrong part of the calendar can swallow a large share of a year's allowance in one go. Students take it because company experience feels obviously worth having, then find in November that they cannot accept a paid role because the days are gone. Worse, a long placement can push you past the limit outright, which is a residence-permit problem rather than a scheduling one.

What makes an internship mandatory

Mandatory means your study regulations require it, usually with credits attached and a defined duration. If you could graduate without it, it is not mandatory, however strongly a professor recommended it. Keep the curriculum page or the examination regulations that impose it, because the exemption is only as good as your ability to prove it when someone asks.

The same distinction drives your pay. The Minimum Wage Act excludes from the minimum wage any internship completed as a compulsory requirement of a school, training or university regulation. So a mandatory placement is free in working days and legally allowed to be unpaid, which is an odd combination the first time you meet it.

Unpaid does not mean uncounted

A paid voluntary internship counts against the account, and its hours are treated like any other work. An unpaid one usually counts too. What matters is whether you chose the placement freely, not whether money changed hands, so an unpaid internship is not the loophole students hope it is.

Pay has its own rule, and it has a hard edge at three months. The Minimum Wage Act exempts a voluntary internship of up to three months taken for orientation before training or study, and a voluntary internship of up to three months alongside a degree, provided you have not already interned with the same employer. Past three months the exemption stops and the statutory minimum wage of EUR 13.90 an hour applies to the whole arrangement. A company offering an unpaid six-month "internship" is describing something the law does not permit.

Weigh the days against what you get

Not every placement is worth its price in days. A three-month unpaid internship at a company that will not hire you afterwards costs the same allowance as a well-paid Werkstudent contract that might. If you need experience and income together, the Werkstudent route generally beats a voluntary internship, and a mandatory placement beats both because it is free. Ask what the placement actually adds to your CV before you spend the allowance on it.

Planning around the limit

If you want the voluntary placement anyway, put it in the lecture-free period. That is not a comfort suggestion about timetables; it is worth roughly half your working days on a three-month placement. Then count what is left and hold some back for the rest of the year. Credits and work days are separate scales

This confuses people. Academic credits and your visa work allowance are not the same system. A mandatory internship earns credits and is study. A voluntary one might also carry credits and still be work as far as your residence permit is concerned. Credits do not buy you days.

Get it in writing

Before you start anything unpaid or ambiguous, ask your international office and, if necessary, the foreigners office. Two things are worth having on paper: written confirmation that the placement is mandatory, and confirmation of which counting method your foreigners office applies to the weeks you work.
