1. Acceptance of Terms
By accessing, browsing, registering on, or otherwise using the GradGermany website, mobile applications, portals, tools, and any associated services (collectively, the "Platform"), you ("User", "you", "your") acknowledge that you have read, understood, and agree to be bound by all of the terms, conditions, policies, and notices set forth herein (collectively, the "Terms"). These Terms constitute a legally binding agreement between you and GradGermany ("Company", "we", "us", "our"), a registered education consultancy operating under the laws of the Federal Republic of Germany and the Republic of India.
If you do not agree with any provision of these Terms, you must discontinue use of the Platform immediately. Your continued use of any part of the Platform following the posting of changes to these Terms constitutes your acceptance of those changes. We reserve the right to modify, amend, or update these Terms at any time, with or without prior notice, and such modifications shall be effective immediately upon posting on the Platform.
2. Description of Services
GradGermany operates as a comprehensive education consultancy platform that facilitates and supports international students in pursuing higher education at accredited institutions within the Federal Republic of Germany. Our services include, but are not limited to:
- Academic profile evaluation and personalised programme recommendations
- University application preparation, review, and submission assistance
- Document verification, certification guidance, and credential assessment support
- Visa and immigration advisory services, including appointment scheduling coordination
- Pre-departure orientation, accommodation guidance, and post-arrival integration support
- Coordination with universities, educational bodies, government agencies, and affiliated partner organisations on the User's behalf
- Provision of informational content, analytical tools, programme databases, and educational resources
In the course of delivering these services, GradGermany may engage, collaborate with, or operate in conjunction with third-party service providers, institutional partners, educational networks, technology platforms, and other entities as necessary to fulfil, enhance, or supplement the services offered to you. The involvement of such parties is an integral and essential component of our service delivery model.
3. User Account & Registration
Certain features and services available through the Platform require you to create a registered user account. By registering, you represent and warrant that all information provided during the registration process and at any subsequent point during your use of the Platform is truthful, accurate, current, and complete. You agree to promptly update your information to maintain its accuracy.
You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to accept responsibility for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other security breach. GradGermany shall not be liable for any loss or damage arising from your failure to comply with this provision.
We reserve the right to suspend, deactivate, or terminate your account at our sole discretion if we reasonably believe that information you have provided is inaccurate, incomplete, or fraudulent, or if your use of the Platform violates these Terms.
4. User Obligations & Conduct
As a condition of your use of the Platform and our services, you agree to:
- Provide only authentic, unaltered, and verifiable documents, academic records, and personal information
- Respond to all communications, requests for information, and document submissions in a timely and diligent manner
- Comply with all applicable admission requirements, deadlines, and regulations of the respective universities and governmental authorities
- Refrain from any fraudulent, misleading, or deceptive activity in connection with the Platform or our services
- Acknowledge and cooperate with our operational processes, which may involve the transmission, processing, and handling of your information through various systems, platforms, and organisational channels as required for service fulfilment
- Not use the Platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Platform
5. Information Collection, Processing & Operational Use
In order to provide, maintain, improve, and expand our services, GradGermany collects, receives, stores, processes, and utilises various categories of information from and about its Users. This information may include, without limitation:
- Personal identification data (full legal name, date of birth, gender, nationality, passport or identity document details)
- Contact information (email addresses, telephone numbers, residential and correspondence addresses)
- Academic and educational records (transcripts, diplomas, certificates, standardised test scores, language proficiency results, grade point averages, course histories)
- Professional and extracurricular information (work experience, internships, research, publications, volunteer activities)
- Documents and files uploaded or submitted through the Platform (including scanned copies, photographs, statements of purpose, letters of recommendation, financial documents)
- Application materials and correspondence related to university admissions, visa applications, and related processes
- Financial and payment information (transaction records, billing details, payment status)
- Technical and usage data (IP addresses, browser type, device identifiers, access timestamps, page views, interaction patterns, referral sources, cookies, and similar tracking technologies)
- Communications and correspondence exchanged through the Platform's messaging and consultation features
By using the Platform and submitting information to us, you expressly acknowledge and agree that GradGermany may process, analyse, aggregate, de-identify, and otherwise utilise this information in any manner consistent with and reasonably related to the provision, administration, improvement, and development of our services and business operations. This includes the use of information for internal research, statistical analysis, quality assurance, service personalisation, and the development of new features, products, and service offerings.
You further acknowledge that the effective delivery of our consultancy services inherently requires the transmission, exchange, and communication of your information across various operational channels, systems, and organisational boundaries. This may involve the processing of your information by internal teams, automated systems, and integrated platforms that collectively support our service infrastructure. GradGermany maintains appropriate operational controls and processes to govern the handling of information within its service ecosystem.
6. Third-Party Service Ecosystem & Collaborative Operations
GradGermany operates within a broad ecosystem of educational institutions, governmental bodies, technology providers, professional service partners, and affiliated organisations (collectively, "Service Partners") to deliver comprehensive and effective consultancy services. You acknowledge and agree that:
- The fulfilment of our services may require, and you hereby authorise, the transmission and exchange of relevant information with universities, accreditation bodies, credential evaluation agencies, visa processing centres, embassy and consulate offices, and other institutional entities involved in your application and admission processes
- GradGermany may engage technology service providers, cloud infrastructure operators, analytics platforms, communication tools, and other operational partners whose services are integral to the functioning of our Platform and the delivery of our services
- We may collaborate with educational networks, partner consultancies, alumni organisations, student support services, accommodation providers, insurance companies, financial institutions, and other entities that contribute to a comprehensive student journey experience
- Information may be processed, stored, or transmitted through servers, systems, and infrastructure located in various jurisdictions, subject to applicable data protection regulations
- GradGermany may, from time to time, participate in industry research, educational market analysis, benchmarking studies, and collaborative programmes with institutional and commercial partners, utilising aggregated, anonymised, or de-identified data derived from Platform usage and service delivery
The engagement of Service Partners is conducted in accordance with our operational requirements and applicable legal frameworks. GradGermany shall not be responsible for the independent actions, policies, practices, or terms of any third-party entity, even where such entity has received information in connection with the delivery of services to you. You are encouraged to review the terms and privacy practices of any third-party platforms or services with which you interact.
7. Consent & Authorisation
By creating an account, submitting any information, uploading any documents, or otherwise engaging with the Platform and our services, you grant GradGermany a non-exclusive, worldwide, royalty-free, transferable authorisation to collect, store, process, use, transmit, and otherwise handle your information in all ways described in, contemplated by, or reasonably related to these Terms and the delivery of our services.
This authorisation extends to all current and future operational processes, partnerships, service integrations, and technological implementations that GradGermany may employ in the course of its business operations. You acknowledge that certain aspects of our service delivery model may evolve over time, and you consent to the application of these Terms to such evolved practices, provided that the fundamental nature of the services remains substantially similar.
Where specific consent is required by applicable law (including the General Data Protection Regulation), such consent shall be obtained separately through appropriate mechanisms on the Platform. To the extent permitted by applicable law, your use of the Platform constitutes consent to the practices described herein.
8. Communications & Notifications
By providing your contact details, you agree to receive communications from GradGermany, including but not limited to service-related notifications, application status updates, appointment reminders, educational information, programme recommendations, newsletters, promotional materials, surveys, and communications from or about our Service Partners and affiliated organisations. You may opt out of non-essential communications at any time through the settings in your account or by contacting us directly; however, you acknowledge that certain service-related communications are essential to the provision of our services and cannot be opted out of while you maintain an active account.
9. Intellectual Property & Content Licensing
All content, materials, software, designs, logos, trademarks, service marks, trade names, text, graphics, images, data compilations, programme databases, analytical tools, algorithms, and all other intellectual property displayed on or available through the Platform are the exclusive property of GradGermany or its licensors and are protected by applicable intellectual property laws. No right, title, or interest in any content is transferred to you through your use of the Platform.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Platform without the prior written consent of GradGermany, except as expressly permitted by these Terms or by applicable law.
9.1 User-Generated Content
By submitting, posting, or uploading any content, materials, reviews, testimonials, feedback, or other information to the Platform ("User Content"), you grant GradGermany a perpetual, worldwide, royalty-free, irrevocable, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and otherwise exploit such User Content in any form, media, or technology now known or hereafter developed, for any commercial or non-commercial purpose, including but not limited to:
- Marketing and promotional activities
- Product development and service improvement
- Content creation and publication on the Platform or third-party platforms
- Analytics, research, and business intelligence
- Licensing to third parties for commercial use
- Inclusion in case studies, testimonials, and success stories
You represent and warrant that you own or have the necessary rights to grant the foregoing license and that your User Content does not infringe any third-party rights or violate any applicable laws.
9.2 Data Analytics & Insights
GradGermany reserves the right to analyze, aggregate, and derive insights from all data collected through the Platform, including User Content, usage patterns, and service interactions. These insights may be commercialized through:
- Market research reports and industry analysis
- Educational trend publications
- Consulting services to educational institutions
- Premium analytics dashboards for enterprise clients
- Data licensing to research institutions and businesses
9.3 Advertising & Sponsorship Rights
GradGermany reserves the right to display advertisements, sponsored content, and promotional materials on the Platform. You acknowledge that the Platform may include third-party advertisements and that GradGermany may receive compensation for such advertisements. Your use of the Platform does not entitle you to any share of advertising revenue.
10. Nature of Services: Facilitation Only — No Guarantee of Admission or Outcomes
YOU EXPRESSLY UNDERSTAND AND AGREE THAT GRADGERMANY ACTS SOLELY AS A FACILITATOR AND ADVISORY SERVICE PROVIDER. GradGermany does not act as an agent, representative, or decision-maker on behalf of any university, educational institution, governmental authority, or regulatory body. Our role is strictly limited to providing guidance, preparation assistance, and facilitation services designed to support your application process. We do not participate in, influence, or have any control over admission decisions, visa determinations, or any other institutional outcomes.
By using our services, you expressly acknowledge, understand, and irrevocably agree that:
- No admission is guaranteed: GradGermany does not and cannot guarantee admission to any university, Studienkolleg, preparatory programme, or any other educational institution, regardless of the level of service provided, fees paid, or the perceived strength of your application profile
- University autonomy: All admission decisions are made solely and exclusively by the respective universities and their admissions committees, acting in their independent and sovereign academic capacity. Each institution applies its own criteria, quotas, capacity constraints, and evaluation methodologies, which are entirely outside of GradGermany's knowledge, influence, or control
- Visa and permit outcomes are not guaranteed: The approval or denial of student visas, residence permits, and any related immigration documents is determined exclusively by the relevant embassies, consulates, immigration offices, and governmental authorities. GradGermany has no influence over, and accepts no responsibility for, the outcome of any visa or permit application
- No warranty of scholarship or financial aid: GradGermany does not guarantee the award of any scholarship, stipend, grant, tuition waiver, or other form of financial assistance. All financial aid decisions are made independently by the awarding institutions and organisations
- Variable outcomes: The success of any application depends on numerous factors that are wholly or partially beyond GradGermany's control, including but not limited to: your academic qualifications, grades, and test scores; the quality, authenticity, and completeness of your submitted documents; the specific admission criteria and capacity of the chosen institution; the number and calibre of competing applicants; prevailing regulatory, political, and institutional conditions; changes in university policies, intake quotas, or programme availability; and the timeliness and accuracy of information provided by you
- Advisory nature only: All information, recommendations, programme suggestions, timeline estimates, eligibility assessments, and guidance provided by GradGermany — whether through the Platform, in consultations, via email, or through any other channel — are based on our professional experience and publicly available information, and are provided in good faith on a best-efforts basis only. Such information does not constitute a guarantee, warranty, promise, or legally binding commitment of any kind, and should not be relied upon as such
- No fiduciary relationship: The relationship between you and GradGermany is that of a service provider and client. It does not create a fiduciary, agency, partnership, joint venture, or employment relationship. GradGermany owes no fiduciary duty to you and is not obligated to act in your interest beyond the scope of services explicitly agreed upon
- Past performance is not indicative: Any statistics, success rates, testimonials, case studies, or examples of past outcomes shared by GradGermany are for informational and illustrative purposes only and do not constitute a guarantee or prediction of future results. Each applicant's circumstances are unique, and past outcomes achieved by other students have no bearing on your individual application
You agree that you shall have no claim, right of action, or entitlement to any compensation, refund (except as expressly provided in Section 11), damages, or other remedy against GradGermany in the event that you do not receive an admission offer, visa approval, scholarship, or any other desired outcome, provided that GradGermany has performed the facilitation services agreed upon in good faith. Your sole remedy in the event of dissatisfaction with the outcome of your application shall be as set forth in Section 11 (Fees, Payments & Refund Policy) and Section 12 (Limitation of Liability) of these Terms.
ADDITIONAL DISCLAIMERS AND ACKNOWLEDGEMENTS:
- Competitive admissions process: University admissions are highly competitive processes where thousands of qualified applicants compete for limited spots. Even applicants with exceptional qualifications may be denied admission due to institutional capacity constraints, programme-specific quotas, regional preferences, or other factors entirely beyond GradGermany's influence or knowledge.
- Programme availability: Universities may cancel, modify, or discontinue programmes at any time without notice. GradGermany cannot guarantee that recommended programmes will remain available or that admission criteria will not change during the application process.
- Document authenticity requirements: Universities and visa authorities require all documents to be authentic, unaltered, and verifiable. Any issues with document authenticity, even if unintentional, may result in application rejection, and GradGermany assumes no responsibility for such outcomes.
- Timing and deadlines: Missing application deadlines, document submission deadlines, or other time-sensitive requirements due to postal delays, technical issues, or other factors outside GradGermany's control may result in application ineligibility.
- Health and eligibility requirements: Certain programmes may have specific health, disability, or other eligibility requirements. Failure to meet these requirements may result in admission denial, and GradGermany provides no guarantees regarding health-related or eligibility assessments.
- Financial requirements: Universities and visa authorities may require proof of financial capability, bank statements, or sponsorship letters. Inability to meet financial requirements may result in rejection, and GradGermany assumes no responsibility for financial assessments or requirements.
- Language proficiency: Language test scores must meet minimum requirements and be valid at the time of application. Score validity periods, testing centre issues, or changes in language requirements may affect eligibility.
- Academic credential evaluation: The evaluation and recognition of international academic credentials varies by institution and may change over time. GradGermany cannot guarantee how your credentials will be evaluated or accepted.
- Visa policy changes: Immigration policies, visa requirements, and processing procedures may change without notice due to political, economic, or security considerations. GradGermany cannot predict or guarantee outcomes in light of such changes.
- Post-admission requirements: Even after receiving conditional admission, students must meet additional requirements such as final transcripts, health checks, or other conditions. Failure to meet these may result in admission withdrawal.
By proceeding with our services, you expressly acknowledge that you fully understand and accept these comprehensive limitations and that you enter into this agreement voluntarily, without any representations or guarantees from GradGermany regarding the likelihood or probability of any specific outcome. You further acknowledge that the consultancy industry operates on a facilitation model where success depends on numerous external factors, and that GradGermany's role is advisory and preparatory only.
11. Third-Party Fees, Payments & Financial Responsibilities
You are solely responsible for all fees, charges, and costs associated with your university applications, visa processes, and related services. GradGermany acts only as a facilitator and assumes no responsibility for the collection, payment, or refund of any third-party fees. The following outlines the typical third-party fees you may encounter:
11.1 University Processing Fees
- Application Fees: Universities charge processing fees for reviewing applications, typically ranging from €50 to €500 per application depending on the institution and programme level. These fees are payable directly to the universities and are non-refundable regardless of admission outcome.
- Enrollment and Registration Fees: Additional administrative fees may be charged upon acceptance, ranging from €100 to €1,000 depending on the institution. These cover registration, student ID, and administrative processing.
- Programme-Specific Fees: Certain programmes may have additional fees for specialized equipment, materials, excursions, or assessments, which vary by programme and institution.
- Language Course Fees: Preparatory language courses (Studienkolleg) and intensive language programmes may incur additional fees ranging from €500 to €5,000 depending on duration and intensity.
11.2 Visa and Immigration Fees
- Visa Application Fees: German embassies and consulates charge visa processing fees, typically €60-€120 for Schengen student visas, payable directly to the embassy. Additional fees may apply for express processing or multiple entries.
- Biometric and Service Fees: Visa application centres charge service fees for biometric data collection and appointment scheduling, ranging from €20 to €80 depending on location and service level.
- Residence Permit Fees: Upon arrival in Germany, you must apply for a residence permit at the local Foreigners' Office (Ausländerbehörde), with fees ranging from €100 to €150.
- Health Insurance Fees: Mandatory health insurance for international students costs approximately €100-€150 per month, payable directly to insurance providers.
11.3 Document and Assessment Fees
- Document Authentication: Apostille and legalization fees for academic documents range from €20 to €100 per document, payable to relevant authorities.
- Translation Services: Official translation of academic documents costs €50-€150 per document, depending on length and language pair.
- Credential Evaluation: Academic credential assessment services charge €100-€300 per evaluation, required by some universities for international qualifications.
- Language Proficiency Tests: TestDaF, DSH, or Goethe Institute examinations cost €150-€250 per attempt, payable directly to testing organizations.
- Medical Examinations: Visa-required medical certificates and tuberculosis tests cost €50-€200, payable to medical facilities.
11.4 Payment Terms and Responsibilities
- Direct Payment Requirement: All third-party fees must be paid directly to the respective institutions, authorities, or service providers. GradGermany does not collect, process, or guarantee payment of any third-party fees.
- Fee Variations: All fee amounts are estimates and may vary based on exchange rates, location, programme requirements, and institutional policies. You are responsible for confirming current fee structures with relevant parties.
- Non-Refundable Nature: Most third-party fees are non-refundable once paid, regardless of application outcomes, admission decisions, or personal circumstances.
- Additional Costs: You may incur additional costs for banking fees, currency conversion, postal services, and other incidental expenses related to your application process.
11.5 Refund Policy for Third-Party Fees
GradGermany has no control over or responsibility for refunds of third-party fees. Refund policies vary by institution and are determined solely by the respective universities, embassies, testing organizations, and service providers:
- University Fees: Refund policies are determined by individual universities and typically do not provide refunds for application or processing fees.
- Visa Fees: Visa application fees are generally non-refundable, even if the visa is denied or you choose not to travel.
- Testing Fees: Language test and examination fees are typically non-refundable once registered or attempted.
- Service Provider Refunds: Refunds for translation, authentication, and other service fees depend on the policies of the respective providers.
You acknowledge that GradGermany provides no guarantees regarding the collection, payment, or refund of any third-party fees, and you assume full responsibility for all financial obligations associated with your university applications and visa processes.
12. Limitation of Liability
To the fullest extent permitted by applicable law, GradGermany, its directors, officers, employees, agents, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform or our services.
GradGermany shall not be held responsible for any actions, decisions, omissions, or conduct of universities, governmental authorities, visa processing centres, Service Partners, or any other third-party entities, even where such entities have been introduced to you or have received information through our services. Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or our services shall not exceed the total fees actually paid by you to GradGermany in the twelve (12) months preceding the event giving rise to the claim.
The Platform and all services are provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless GradGermany, its directors, officers, employees, agents, partners, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Platform or our services; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any information or content you submit, post, or transmit through the Platform; or (e) any fraudulent, misleading, or unlawful activity on your part.
14. Termination & Suspension
GradGermany may, at its sole discretion and without prior notice or liability, suspend or terminate your access to the Platform and services, in whole or in part, for any reason, including but not limited to a breach of these Terms, provision of inaccurate information, fraudulent activity, or inactivity. Upon termination, your right to use the Platform shall immediately cease.
You acknowledge that certain provisions of these Terms shall survive termination, including but not limited to provisions relating to intellectual property, limitation of liability, indemnification, data processing authorisations (to the extent applicable under law), and dispute resolution. GradGermany may retain information collected during your use of the Platform as required by applicable law, contractual obligations, or legitimate business purposes, and may continue to process such information in accordance with these Terms and applicable legal requirements.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany and, where applicable, the laws of the Republic of India, without regard to their conflict of law provisions. GradGermany operates under the legal frameworks of both jurisdictions, and Users accessing the Platform from India are additionally subject to the Information Technology Act, 2000 (as amended), the Indian Copyright Act, 1957, the Consumer Protection Act, 2019, and all other applicable Indian legislation and regulations.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If such negotiation fails within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in Delhi, India, or alternatively, for Users based in India, the competent courts in New Delhi, India, at GradGermany's sole discretion.
To the extent permitted by applicable law, you agree to waive any right to participate in class actions or class-wide arbitration in connection with any dispute arising from these Terms or your use of the Platform.
16. Severability & Entire Agreement
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving its original intent.
These Terms, together with our Privacy Policy, Imprint, and any other policies or agreements referenced herein or published on the Platform, constitute the entire agreement between you and GradGermany regarding your use of the Platform and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.
17. Prohibited Automated Access, Scraping & Bot Usage
YOU EXPRESSLY AGREE THAT ALL FORMS OF AUTOMATED ACCESS TO THE PLATFORM ARE STRICTLY PROHIBITED. Without the prior express written consent of GradGermany, you shall not, and shall not permit any third party to:
- Use any robot, spider, crawler, scraper, data miner, or any other automated tool, programme, script, or process to access, index, harvest, collect, store, copy, or reproduce any content, data, or information from the Platform
- Deploy automated bots, agents, or software to interact with, query, or extract data from the Platform, including but not limited to university listings, programme databases, service descriptions, pricing information, user-generated content, or any other proprietary data
- Use artificial intelligence, machine learning, or large language model (LLM) systems to scrape, crawl, train on, fine-tune with, or otherwise process content from the Platform
- Circumvent, disable, or interfere with any security features, rate-limiting mechanisms, access controls, CAPTCHA systems, or other protective measures implemented on the Platform
- Create derivative databases, datasets, or data compilations from content obtained from the Platform through any means, whether automated or manual
- Mirror, frame, or create any unauthorised copy of any portion of the Platform or its content
- Access or attempt to access the Platform through any means other than a standard web browser operated by a natural person, except through APIs explicitly provided and authorised by GradGermany
- Systematically download, store, or redistribute programme data, university information, or any other structured data from the Platform
- Use the Platform's content to build, enhance, or operate any competing service, product, or database
GradGermany actively monitors for automated access and employs technical measures to detect and block bot activity, scraping attempts, and unauthorised data extraction. Violation of this section may result in immediate and permanent termination of access, IP blocking, and legal action under applicable German, European Union, and Indian law, including but not limited to the EU Database Directive (96/9/EC), the German Copyright Act (Urheberrechtsgesetz), the German Unfair Competition Act (UWG), the Computer Fraud and Abuse provisions of the German Criminal Code (StGB), the Information Technology Act, 2000 (India) including Sections 43 and 66 relating to unauthorised access and computer-related offences, the Indian Copyright Act, 1957, and the Bharatiya Nyaya Sanhita (BNS), 2023.
